Refund Policy

This page explains how imem handles trial cancellation, subscription cancellation, billing corrections, credits, and refund requests.

1. Scope

This Refund Policy explains how Bluebird AI Pty Ltd (ABN 85 696 013 788) handles refund, credit, cancellation, and billing-error requests for imem subscriptions and trials.

This policy applies to imem's hosted web vault, MCP server, Obsidian sync support, billing flows, support tools, APIs, and related subscription services.

This policy forms part of our Terms & Conditions. If there is any inconsistency, your rights under the Australian Consumer Law or any other non-excludable law prevail.

2. Trials and cancellation

A 14-day trial may start without a payment method. If no payment method is added before the trial ends, there is no subscription charge for that trial period.

Where a plan includes a 14-day trial, you can cancel before the trial ends and you will not be charged for that subscription period.

Paid subscriptions renew automatically until cancelled. You can manage or cancel your subscription through the billing page or the Stripe customer portal.

Cancelling a paid subscription stops future renewals. Unless required by law or expressly agreed by us, cancellation does not automatically refund charges already paid, and access normally continues until the end of the paid billing period.

3. When refunds are available

Your rights under the Australian Consumer Law and any other non-excludable consumer protection laws are not limited by this policy.

If imem fails to meet a consumer guarantee that applies to you, you may be entitled to a remedy such as repair, replacement, resupply, refund, cancellation, or compensation depending on the circumstances and applicable law.

If we charge you incorrectly, duplicate a charge, apply the wrong plan price, or fail to honour a valid cancellation before renewal, we will correct the billing issue, which may include a refund or account credit.

We may also choose to provide a refund or credit at our discretion where doing so is fair and practical, even if the law does not require it.

4. When refunds are not guaranteed

Refunds are not guaranteed for change-of-mind cancellations, account inactivity, unused time, accidental renewal after a user-controlled cancellation period, unsupported third-party clients, or a decision to stop using imem after the service has been made available.

We do not guarantee refunds for issues caused by third-party tools, AI clients, payment processors, email providers, operating systems, browsers, network providers, or user-managed provider API keys where the issue is outside our reasonable control, unless required by law.

Plan limits, throttling, temporary queues, maintenance windows, and reasonable anti-abuse safeguards do not automatically create a refund right unless they amount to a failure of an applicable consumer guarantee.

5. How to request a refund or billing correction

Email hello@imem.ai with the subject "Refund request" or "Billing correction". Include your account email, plan, charge date, invoice or Stripe receipt if available, and a short description of the issue.

Requests are easier to assess if made within 30 days of the charge, but this timing does not limit any rights you have under Australian Consumer Law or another non-excludable law.

We may ask for more information to verify your identity, locate the charge, understand the issue, or prevent fraud and abuse.

6. Refund processing

Approved refunds are normally returned to the original payment method through Stripe or our payment processor.

Payment processors and banks control final settlement timing. A refund may take several business days to appear after it is approved.

Where a refund is not practical through the original payment method, we may offer another reasonable remedy such as account credit, resupply, or manual correction, subject to applicable law.

7. Changes

We may update this Refund Policy from time to time. If changes are material, we will take reasonable steps to notify you, such as updating this page, sending an email, or showing an in-product notice.

Changes apply prospectively and do not limit non-excludable rights you already have under applicable law.
